Clinic Inseminates Woman with Wrong Sperm

A fertility clinic used the wrong sperm to inseminate a woman with sperm other than her husband's and a New York judge is allowing the couple to sue the clinic in a medical malpractice lawsuit.

The couple filed the lawsuit after the wife gave birth to their daughter whose skin was too dark to be their child. The judge notes the couple had three DNA tests done to confirm their suspicions that her husband was indeed not the baby's biological father. One test was done at home and the other two were professional lab workups.

The couple, of Commack, New York, is suing New York Medical Services for Reproductive Medicine, alleging the Manhattan clinic of medical malpractice amongst other offenses.

The couple contends that they love their daughter, but that she is also a daily reminder of the mistake that was made.
