As A lawyer directly involved in the medical malpractice debate I have personal experiences that reflect the true nature of the problem. Lawyers and lawsuits are not the cause of any so called medical malpractice crisis. In fact given the sorry state of the health care system in this country lawyers are the last and sometimes only line of defense for those who are negligently and carelessly harmed by the healthcare system.

If patients harmed by medical negligence could not seek legal help who would help them? If a potential for a lawsuit did not exist who would regulate and supervise the healthcare system? Clearly the government cannot or will not regulate the rampant errors that plague our system. We spend more on healthcare than any other country yet what we get does not compare. It is not lawyers that cause bad healthcare. The number of claims reflects the state of the system. The governments answer to poor care to to regulate or ban lawsuits. Why? So the systems errors will not be brought.
