Fisher-Price Recalls Almost 1 Million Toys Due to Lead in Paint

The CPSC and Fisher-Price Inc. are recalling 967,000 toys because the surface paint contains too much lead. Lead is toxic and if it is ingested by children, lead can cause health problems. Over 83 different types of toys are included in the recall, such as popular Sesame Street and Dora the Explorer toys.

The recalled toys were manufactured in China and were then distributed in stores all over the United States. The toys were available from May 2007 to August 2007. This is the first recall for Fisher-Price since 1998, when the company had to recall 10 million Power Wheels toys.

The general manager of Fisher-Price, David Allmark, said that the problem was found by an internal probe, and was then reported to the CPSC. Allmark stated that this recall is troubling because the company had a good and long-standing relationship with the Chinese vendor. The company will now have to monitor vendors and safety standards more closely.

Allmark stated, "We are still concluding the investigation, how it happened. ... But there will be a dramatic investigation on how this happened. We will learn from this."

The recalled items were manufactured between April 19 and July 6, 2007 and all are marked with "Fisher Price". The toys may include a date code between 109-7LF and 187-7LF, which would be labeled on the product or the packaging.

Lead poisoning can cause brain and kidney damage, especially in young children. Symptoms of excessive lead exposure include nausea, headaches, constipation, seizures, and coma.

For more information on this subject, please refer to our section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Jenny Albano

Abuse of lawsuits? Does anyone care when big business brings questionable lawsuits

Another example of the big business insurance company hypocrisy. The continuing pursuit of college students and others for music downloading. Check out this article does anyone care?http://news.yahoo.com/s/ap/20070513/ap_en_ot/music_piratesBut The same groups complain about lawsuits for car accident motorcycles , slip and fall and construction accidents. The system is fair and should be presented that way. The courts are for all who believe they have a legal claim for damages.

Originally posted at InjuryBoard by Joe Stanley

Car Insurance - Syracuse, Watertown

Few people are aware of the different part of there car insurance policy. In fact, I would guess that most people do not even read there policy. However, the policy contains many different provisions and it is very important to understand the different sections.

First, we are all aware that we have liability coverage in the event that we strike/injure another person. The minimum limit in New York is $25,000. However, to properly protect yourself, a determination must be made based on your personal assets. If you have sufficient assets in the form of savings, homes, cars, boats etc substantially more than the minimum is probably required.

In addition to liability coverage their is optional collision coverage which will pay for the repairs to your vehicle in the event it is damaged as a result of your own negligence. This coverage is optional (unless the vehicle has a loan or is leased). Without this coverage you will be personally responible for the repairs.

If the vehicle has a loan you should have "gap" coverage which will cover the difference between the value of the car and the loan. We all have heard that the car depreciated when you take it off the lot which is true however the loan does not. Thus, you may have a vehicle worth $10,000 and a loan of $15,000 - in the event the car is totalled - you would be responsible for the $5,000 difference - gap insurance prevents this problem.

No-fault insurance will pay for your medical bills and lost wages. Basic coverage requires no-fault to pay a maximum of $2,000/month in lost wages. Thus, if you have income in excess of $30,000 you should consider additional no-fault coverage.

The policy also contains underinsured motorist coverage. This is coverage that protects you in the event you are injured by another motorist. For example is that other party has the minimum $25,000 set forth above and you purchased $100,000 underinsured motorist coverage - you would be able to collect, assuming you had the requisite injury, the $75,000 difference. This coverage is usually inexpensive and should be considered by all.

Insurance policies are complex. If you are injured in an accident it is best that you contact an attorney to preserve all your rights. Strict time deadlines exist for many portions of the policy, thus contact an attorney early is important.http://www.ins.state.ny.us/ogco2004/rg040428.htm

Originally posted at InjuryBoard by Rob Quattrocci

Car crashes and young drivers

Upstate New york has been ravaged over the last several years by tragic car accidents involving teenagers - the latest being two F-M students. It would be nice if their was an easy solution but there is not. Education and training is the best way to show young drivers the risks and dangers of operating cars motorcycles trucks snowmobiles and ATVs. As an attorney handling personal injury claims we see the tragic results. It is impossible to change things after they happen so they old adage an ounce of prevention is worth a pound of cure.

Bad driving of motorized vehicles is not limited to young people. We are involved with trying to help people of all ages who have been devastated by the negligent driving of others. We all need to be alert watch out for others. No one ever wants to need the services of a personal injury attorney after a bad injury. Broken bones brain injuries and trauma leave permanent scars. As lawyers, when our clients are hurt we try to recover damages that fix what can be fixed, help what can be helped and be compensated for what can't be fixed or helped.

Originally posted at InjuryBoard by Joe Stanley

Dog Bites - Watertown - The one free bite rule

In New York we have law in effect that requires someone injured by a dog to show that the dog had prior vicious propensities. This can be shown in a number of ways including showing that the dog had bitten someone else prior to your bite or by showing that the dog exhibited vicious tendencies such as bearing his teeth, growling etc. Showing that a dog had prior vicious propensities can be very difficult as the owners rarely admit such facts and other parties often do not want to get involved. Therefore, it is essential that you contact an attorney immediately after the dog attack.

http://www.dogbitelaw.com/PAGES/statistics.html

Stanley Law Offices has been handling dog bites in the Watertown, Northern New York area for a decade and will thoroughly investigate these cases. We understand that often children are involved in said attacks and do everything within our power to hold dog owners responsible in these circumstances.

Originally posted at InjuryBoard by Rob Quattrocci
