Most people fail to realize that even if they have liability insurance that does not mean that their insurance company will come to their defense if they get sued. Especially in New York. New York Unlike most states does not require insurance companies to be prejudiced if their insureds fail to comply with some technical and unfamiliar rule in the insurance policy.

New Yorks legislature passed a bill to help consumers faced with this potentially very expensive problem. Unfortunately for no good reason the governor vetoed the bill. As a result insurance companies can continue to use unfair and technical excuse to avoid payment

The news is full of stories about the 65,000,00.00 pants lawsuit. It is being used by the insurance industry and those seeking to limit the rights of injured people as an example of a "frivolous lawsuit"ABC News
This is not news. The claim is a joke and has no relationship to the judicial system. Our system allows people to attempt stupid things but they are appropriately punished if they are "frivolous".This is a foolish commercial dispute and should not be used to justify in away limiting the rights of the injured by negligent doctors drivers construction site owners and all who cause harm by negligent and careless actions. Speak out do not be fooled.
